These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your", or "User") and Clatter Labs or Clatter AI ("Clatter", "we", "us", or "our").
By accessing, registering for, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms in their entirety, you must not access or use our services.
These Terms apply to all services and products offered by Clatter, whether currently available or launched in the future.
2. Description of Service
Clatter provides an AI agent platform that enables users to create, customize, deploy, and manage AI-powered chat agents for their websites and applications. Our services include, but are not limited to, agent creation tools, knowledge base management, conversational AI capabilities, analytics, and API access.
3. Account Responsibilities
You are solely responsible for maintaining the confidentiality and security of your account credentials, API keys, and any other access information. You agree to accept full responsibility for all activities that occur under your account, whether authorized by you or not. Clatter shall not be liable for any loss or damage arising from your failure to maintain the security of your account.
4. Usage & Credits
Clatter operates on a credit-based usage system. Credits are deducted based on your AI agents' activity, including but not limited to message processing, API calls, and other platform usage. Unused credits do not roll over to the next billing period unless explicitly stated otherwise in your subscription plan.
5. Acceptable Use
You agree not to use Clatter for any unlawful, harmful, abusive, or fraudulent purposes. This includes, without limitation, generating harmful, misleading, discriminatory, or illegal content, attempting to overload or abuse the platform's resources, or violating any applicable laws or regulations.
We reserve the right to suspend or terminate your account immediately if we determine, at our sole discretion, that you have violated this Acceptable Use policy.
6. Intellectual Property
You retain all ownership rights to the content, data, and materials you upload or provide to the platform ("Your Content"). By using our services, you grant Clatter a worldwide, non-exclusive, royalty-free license to host, store, process, and use Your Content solely to the extent necessary to provide and improve the services.
Clatter retains all right, title, and interest in the platform, underlying technology, software, branding, and all intellectual property rights associated therewith.
7. Payment & Refunds
All payments are processed through Stripe. You are responsible for providing accurate and complete billing information. All sales are final and non-refundable except at Clatter's sole discretion. Refunds for unused credits may be considered only if requested within 14 days of purchase.
8. Limitation of Liability
The service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind. To the maximum extent permitted by law, Clatter shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the service, even if advised of the possibility of such damages.
9. Changes to Terms
We reserve the right to modify or update these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the service after the changes become effective constitutes your acceptance of the revised Terms.
